6. Terms of Delivery for Goods

Delivery is generally carried out by various shipping service providers. The applicable costs must be paid in advance by the buyer.

The goods ordered by you in our online shop will be shipped to you within the delivery times specified for each product, depending on the destination. You can use the tracking number to monitor the current location of your order. In principle, the production order is placed only after the expiration of the 14-day withdrawal period (example: delivery time 6 weeks + 2 weeks withdrawal period = 8 weeks delivery time). However, you can waive the right of withdrawal. If the goods are marked without a specified delivery time at the time of your order, Nova SUPERB by palindrom GmbH will strive to deliver the goods as soon as possible. Nova SUPERB by palindrom GmbH will make every effort to adhere to the specified delivery times. However, Nova SUPERB by palindrom GmbH is not responsible for delivery delays, for any reason.

 

We will inform you immediately of any delivery delays. If the delivery delay lasts longer than 5 weeks from the original delivery date, the customer has the right to cancel the order, but only if production has not yet begun. Further claims, especially claims for damages, are excluded. If the delivery of the goods fails due to the customer's fault (despite 3 unsuccessful delivery attempts), Nova SUPERB by palindrom GmbH may withdraw from the contract. Already made payments will NOT be refunded, as these are specially manufactured goods for you.

7. Retention of Ownership

Nova SUPERB by palindrom GmbH remains the owner of the delivered products until they have been fully paid for.

8. Right of Withdrawal and Return of Goods

Conditions

For all purchases of our goods through our online shop (except for certain products; see the restrictions of the right of withdrawal below), you have the right of withdrawal as a consumer within 14 days after concluding the contract. You can revoke your declaration of intent within 14 days. After receipt, you have no right to return the goods since they are products specially made for you.

Consequences of Withdrawal

If you withdraw from the contract, we will refund you the total price paid, including delivery costs, immediately and no later than 14 days from the day we are informed of your decision to withdraw from this contract.

The refund will be made using the originally used payment method and will always be transferred to the corresponding account used for payment unless expressly agreed otherwise; in no case will you be charged fees for this refund. Make sure you have access to the specified account, as Nova SUPERB by palindrom GmbH assumes no liability in this regard.

9. Notice of Defects, Warranty

NOVA superb by palindrom GmbH guarantees that the goods correspond to the agreed-upon characteristics and are free from defects that negate or diminish their value or suitability for the intended use. The customer must check the goods for accuracy, completeness, and any damage immediately upon receipt. Any defects or damages must be reported to NOVA superb by palindrom GmbH within 5 working days. Defects that could not be detected during proper inspection and only arise later must be reported in writing immediately upon discovery. If you fail to inspect the goods immediately or notify us promptly, the goods are considered approved, and you can no longer assert any claims against us. Defects are to be reported with the defect form. The legal warranty provisions apply for manufacturing/material or production defects. Excluded from the warranty are products damaged due to the buyer's own fault:

  • Damages caused by the buyer when unpacking the delivered goods

  • Misuse by the buyer

  • Abuse by the buyer

  • Intentional damage by the buyer

  • Negligent damage by the buyer

The customer's warranty claims are limited to the elimination of defects/repair, excluding all other claims, especially reduction or compensation for defects and consequential damages. NOVA superb by palindrom GmbH decides at its discretion on the rectification of defects. If replacement or defect rectification fails, the customer is entitled to withdraw from the contract in case of significant defects. To report complaints or service issues, please use the following form and provide the order number, customer number, a description of the error, and other helpful information. You are obliged to document the damage with photos and explain the damage in writing. The defective product must be returned to the following address of Nova SUPERB by palindrom GmbH after submitting the defect form along with a copy of the invoice.

The return of goods is at the customer's expense and risk. Please request confirmation of the return and keep it, as your warranty claim cannot be processed if the package is lost.
